§ 66-6. Concealed handguns in weapon free school zones and on city property.

  • (a)

    Definitions. The following words, terms and phrases, when used in this section, shall have the meanings ascribed to them in this subsection, except where the context clearly indicates a different meaning:

    License holder shall mean any person who is a valid holder of a concealed handgun permit under the authority of 41 Texas Gov't Code, Subchapter H, §411.

    Premises shall mean a building or portion of a building. The term does not include any public or private driveway, street, sidewalk or walkway parking lot, parking garage or other parking area.

    Prohibited weapon shall refer to any weapon prohibited by Texas Penal Code § 46.05(a).

    (b)

    Weapon free school zones.

    (1)

    No person or license holder may possess any prohibited weapon within any weapon free school zone. A map prepared by the city engineer, setting forth the locations of the weapon free school zones within the City of Mission, Texas, is attached as Exhibit A to Ordinance No. 3003 and incorporated by reference herein. This map setting forth the boundaries of the weapon free school zones is adopted as an official finding and record of the location and boundaries of those zones.

    (2)

    The city engineer is hereby directed to immediately file a copy of this map with the Hidalgo District Clerk, which will serve as public notice of these weapon free zones.

    (c)

    Concealed handguns prohibited on certain premises. No license holder may carry any concealed handgun on the following premises within the City of Mission, Texas:

    (1)

    The City of Mission Public Safety Building, located at 1200 East 8th Street, Mission, Texas 78572.

    (2)

    The Offices of the Municipal Court (City Hall) located at 1201 East 8th Street Mission, Texas 78572.

    (3)

    The City of Mission Speer Memorial Library, located at 801 East 12th Street, Mission, Texas utilized by the City of Mission under a preexisting memorandum of understanding for conducting GED Classes, attached to Ordinance No. 3003 as Exhibit B and incorporated by reference herein.

    (4)

    The City of Mission Parks & Recreation Building (the Armory) located at 721 N. Bryan Road, Mission, Texas 78572, utilized by the City of Mission under a preexisting memorandum of understanding for conducting GED Classes, attached to Ordinance No. 3003 as Exhibit C and incorporated by reference herein.
